Dump Your Pen Friend Lawsuit

A North Texas mother sued Virg.n Mobile USA, Virg.n Mobile Australia, Creative Commons Corp., and Flickr.com. on behalf of her 16 year-old-daughter in state court in Dallas County, Texas for the unauthorized use of her daughter's image in an ad campaign promoting Virg.n Mobile Australia's services.

The court documents are not yet available on the Dallas County Court's website. We contacted the attorney for Ms. Chang and requested a copy of the pleadings for our review. Without viewing the court documents, one can speculate the law suit is for common law misappropriation claims such as right of publicity and right of privacy and unfair competition.
