Should I Register My Brand on the Amazon Brand Registry?

If you are selling products online and have a pending trademark application or a trademark registration, you should apply for the Amazon Brand Registry. Registration on the Brand Registry is one the most efficient ways to fight unauthorized uses of your trademark by third parties.

How Can My Trademark/Brand Qualify For The Amazon Brand Registry?

  1. Active trademark application or registration: You must have a pending trademark application or registration in one of the following countries: United States, Brazil, Canada, Mexico, Australia, India, Japan, France, Germany, Italy, Turkey, Singapore, Spain, Netherlands, Saudi Arabia, the United Kingdom, Egypt, Sweden, Poland, Belgium, the European Union, and the United Arab Emirates.

  2. Produced products: The brand must produce original product offerings and not merely resell products from other brands. Your brand/trademark must be on your product packaging.

  3. Proof of ownership: The applicant must provide proof of ownership of the trademark, such as a trademark application serial number or trademark registration number.

  4. Brand website: The brand must have an active and fully operational website that provides information about the brand and its products.

  5. Accurate product information: The product information provided to Amazon must be accurate and up-to-date.

  6. List of product categories: When you enroll you will provide a list of product categories (e.g., apparel, sporting goods, electronics) in which your brand should be listed.

  7. Compliance with Amazon policies: The brand and its products must comply with Amazon's policies, including its intellectual property and product safety policies.

By meeting these criteria, your trademark may be eligible for registration on the Amazon Brand Registry, which provides access to enhanced tools and services to protect and promote your brand on Amazon. If you do have a pending US trademark application or trademark registration, the attorney of record for your application will receive a notification from Amazon once you apply for the Amazon Brand Registry.
